Inquest into the Death of James Atkinson concludes.

The inquest into the death of James Atkinson, who died after eating a takeaway pizza, has found that he suffered an anaphylactic reaction because the pizza contained peanuts, to which he was allergic.

James Atkinson, who died in 2020 aged 23, ordered a chicken tikka pizza from the local Dadyal restaurant via the Deliveroo app. The restaurant’s menu did not contain information about allergens on the Deliveroo app.

The Inquest heard evidence of the restaurant owners using mixed nut powder which contained up to 99% peanuts, and which was  cheaper than almond powder. The restaurant’s menu did not contain information about allergens an the Deliveroo app.

In her conclusion, the Coroner, Karen Dilks supported the family’s calls for mandatory requirements for allergen information to be included on all menus (which is being considered under Owen’s Law). After the inquest, the Food Standards Agency also backed the family’s calls for change.

Prevention of Future Deaths reports were made to NHS England, the Department for Health and Social Care, Newcastle City Council and the Food Standards Agency.

James’ family were represented by partners at law firm Leigh DayJill Paterson and Thomas Jervis. The family had instructed barristers Craig Hassall KCJanine Wolstenhome and Helena Spector.
